Property Taxes in New York: How to Claim Your Money Back?

Errors in New York property records can cost homeowners thousands of dollars, but the Department of Finance allows property owners to correct these mistakes and potentially recover overpaid taxes by submitting an Administrative Review Application with supporting documentation.

Errors in New York property records can cost homeowners and building owners thousands of dollars. Fortunately, the system allows for correcting that data and, in some cases, recovering overpaid taxes. The city’s Department of Finance (DOF) administers the physical and fiscal information of properties. When the square footage, number of units, or classification are incorrectly recorded, the tax bill usually inflates.

Property owners, especially condo and cooperative boards, should review their notices annually. If they detect an objective error, they can request an administrative correction without needing a lengthy lawsuit. However, the process requires evidence, is governed by strict deadlines, and does not guarantee an automatic refund check.

What Errors Can Be Corrected Before the Department of Finance?

The DOF allows correction of physical, transcription, or classification errors that directly affect the tax. It does not address disputes over how much the property is worth on the market; that complaint goes to another authority. A recent case reported by ABC7 showed how an Upper West Side cooperative paid taxes on 119,228 square feet for decades. An architect measured the building and verified that the actual square footage was 93,759 square feet.

That difference of more than 25,000 square feet increased the annual bill for all residents. After presenting the evidence, the city adjusted the record. Correctable errors include mathematical errors, nonexistent units, incorrect square footage, or physical changes recorded incorrectly. The taxpayer must use the Administrative Review Application to initiate the process.

To support the claim, the property owner must submit official documents. This includes approved floor plans, certificates of occupancy, reports from engineers or architects and the affected invoices. It is not enough to argue that the tax is too high. The claim must prove that the city used false data to calculate it.

How Many Years Back Can You Claim?

The DOF’s general rule allows review of up to three years. Specifically, the department analyzes the current fiscal year and the two immediately preceding fiscal years from the date of the request. However, in cases of serious administrative errors or failures exclusive to the department, the correction can cover up to six years retroactively.

This means that a cooperative board will not recover overpayments from 40 years ago, even if the error existed that entire time. Recovery is limited to the current review window. Property owners can submit the Administrative Review Application at any time of year. They are not subject to the short spring appeals window, because physical errors can be reported continuously.
