A new Florida law will strengthen privacy protections for critical data at the DMV. This involves email addresses submitted during various transactions. The measure aims to reduce risks of identity theft and fraud.
What Does SB 490 Entail?
SB 490 expands privacy protections for emails collected by the DHSMV. This agency performs DMV functions in the state of Florida.
The law takes effect on October 1, 2026. It applies to driver’s license, identification card, license plate, and vehicle or vessel registration transactions.

What Exactly Changes With This Law?
Previously, public records exemptions protected only emails used for renewal notices. Now, SB 490 extends that protection to general agency notifications.
This includes messages about driver’s licenses and state identification cards. It also covers license plates, vehicle registrations, and vehicle title documents.
Additionally, it applies to vessel registrations and notices of license suspension or cancellation. Therefore, those emails will be exempt from disclosure in response to public records requests.
Does This Protection Apply to Emails Already Registered Before?
Yes, the rule applies retroactively. This includes email addresses that the DHSMV had already collected before this date.
Therefore, it is not necessary to re-register your email address to obtain this protection.
How Long Will This Protection Remain in Effect?
As a public records exemption, it is subject to legislative review. This occurs under the Open Government Sunset Review Act.
If lawmakers do not renew it, the protection will expire on October 2, 2031. Therefore, this measure is not necessarily permanent in the long term.
What Does NOT Change With This Law?
SB 490 does not make all DMV documents private. Nor does it completely modify who can access driver or vehicle records.
Its scope is limited specifically to emails collected for notifications. The rest of the information follows normal public access rules.
Additionally, personal data from licenses and vehicles already have protection under federal law. This is the Driver’s Privacy Protection Act, although exceptions exist for certain permitted uses.
What Is the Relationship to SB 488?
SB 490 functions as the privacy rule linked to SB 488. This latter law allows the DHSMV to use email in addition to postal mail.
Thus, the agency can send notices about licenses, identification cards, and vehicle registrations by email. SB 490, for its part, protects those emails used for those notifications.
