What is law S9005? New York approves restrictions on ICE operations

New York’s new law S9005 is now in effect and restricts the use of masks by state and local law enforcement agents. The measure has also triggered a lawsuit from the Department of Justice, which accuses the state of interfering with federal functions, including ICE operations.

For many immigrant families, the regulation represents greater transparency on the streets. For the federal government, however, it opens a constitutional clash that could escalate in courts and change how agents operate.

What does law S9005 establish?

Law S9005 is part of the state budget signed by Governor Kathy Hochul. Its core is clear: most agents cannot cover their faces while interacting with the public.

The law also requires that identification be visible. In practice, it mandates name, badge, or both on the uniform, with specific exceptions.

Those exceptions include health situations, fires, undercover operations, and tactical squad tasks. According to the legislative proposal published by the New York Senate, the intent is to limit anonymity in public operations.

Hochul celebrated the law taking effect on June 26. In a public statement, she said New Yorkers have the right to know who exercises authority in their communities x.com/GovKathyHochul.

Why did the federal government react?

The Department of Justice filed a lawsuit shortly after the law took effect. Its main argument is that New York cannot regulate how federal agencies operate within its territory.

According to the lawsuit cited by Reuters, the law violates the Supremacy Clause of the Constitution. The DOJ also alleges that the regulation endangers agent safety and complicates operations.

The conflict directly involves ICE. For the federal government, a state rule cannot impose sanctions on officials acting under national authority.

The lawsuit was filed against the state, Governor Hochul and Attorney General Letitia James. The case has already opened a dispute over whether local transparency rules can apply when the agency is federal.

The Department of Justice argues that New York’s rules could expose agents to harassment or attacks. That position appears in court documents released by DOJ officials.
