Governor Kathy Hochul and Attorney General Letitia James argue that the White House wants to block rules that protect public safety. They also contend that the state has the right to regulate the conduct of officers within its borders.

Which laws are in dispute?

One of the regulations prohibits local, state, or federal officers from covering their faces with masks when interacting with the public. It also requires them to identify themselves clearly. The state says this measure seeks transparency and trust.

James defended the law in a statement cited by EFE. According to her, hiding one’s face and avoiding identification puts New Yorkers at risk. She also argued that this behavior weakens public accountability.

Hochul reinforced that idea. She noted that a badge implies clear duties to the public. In her view, residents deserve to know who is enforcing the law. This assertion resonates with widespread concerns among immigrants and Latino communities.

The other regulation prevents detaining people solely for federal immigration civil violations. It also limits the use of public funds for migrant detention centers for those reasons. The state considers the measure protects local resources and prevents abuse.

The lawsuit also recalls a raid in Chinatown last year. In that operation, masked agents detained several people. Witnesses complained during the action. That episode became an example of the tension between security and transparency.

Why does the state invoke the Tenth Amendment?

New York asked the court to declare illegal the federal pressure against these laws. Hochul and James argue that the Trump administration is overriding state authority. Their legal basis is the Tenth Amendment, which reserves powers to the states.

According to the state, regulating public safety within its borders is a sovereign right. That phrase is significant. At its core, the dispute is not just about immigration. It is also about which level of government controls the streets.
