DHS Threatens Jail Time for Officials Who Don’t Follow Trump

Department of Homeland Security Secretary Markwayne Mullin has taken the Trump Administration’s electoral messaging to a new level of institutional confrontation. In a public statement, he warned that state election officials could face fines and even prison sentences if they do not follow federal government directives to «purge» voter rolls and detect alleged registrations of non-citizens. The announcement comes amid high political tension, with midterm elections approaching and a president insisting on discrediting past electoral processes.

What Is DHS Demanding From States?

Mullin asserted that the Department of Homeland Security (DHS) conducted a preliminary analysis. He claims there are more than 250,000 non-citizens in the voter rolls of 4 states: California, New Jersey, Nevada, and Pennsylvania. According to the secretary, these are records that must be reviewed and, if necessary, purged using a federal database containing immigration and Social Security information.

The central demand is that states cross-reference their voter lists with this federal registry. The administration also seeks for them to actively collaborate with the central government in the «purging» of alleged non-citizen voters. Mullin warned that those who refuse could lose access to federal funds for election administration and, in cases the government deems serious, face criminal penalties.

In his statement, the secretary said that «if you are an undocumented migrant and tried to vote, or if you tried to vote illegally in someone else’s name, we will find you and prosecute you.» That phrase summarizes the official narrative: presenting the operation as an effort to ensure that only people «legally authorized» to vote do so. However, the technical details of how they identify these alleged voters have generated concern among experts.

Why Is the Use of Federal Databases Drawing Criticism?

The database the DHS wants to use was originally designed to verify eligibility for immigration benefits and federal programs. A federal judge blocked its use for electoral purposes, deeming it a violation of norms regarding disclosure and use of data linked to Social Security. This is precisely because of the risk of employing it outside the context for which it was created.

Additionally, this tool has proven prone to errors when used to review voter rolls. It tends to flag newly naturalized citizens as if they were non-citizens, simply because their status has not yet been reflected in all records. Voting rights advocacy organizations have documented cases in which people with full citizenship were incorrectly identified and risked being removed from voter lists.

Electoral records were designed to register voters, not to remove them en masse. They always include deceased persons, because updating requires time, coordination with civil registries and continuous action by state offices. Converting this administrative reality into justification for accelerated purges increases the risk of excluding legitimate voters, especially in immigrant communities where changes in migration status are frequent.
