Shipwreck in New York: ICE Detains Captain After Death of Mother and Baby

The captain of the vessel that capsized in New York Harbor earlier this month was detained by the Immigration and Customs Enforcement Service. The accident resulted in the death of a mother and her five-month-old baby.

Manuel Ernesto Hernández-Umana, 46, was arrested on August 9. Authorities charged him after a boat carrying 14 people capsized near the Statue of Liberty. The complaint, filed in the Southern District of New York, states that he was piloting without proper licenses.

According to court documents, his boat, a Yamaha AR210, exceeded the maximum capacity allowed at the time of the capsizing. This combination of factors sparked a tragedy that today shakes the Hispanic community of Queens and the entire New York area.

How ICE Located the Boat Captain

The Department of Homeland Security explained the process that led to Hernández-Umana’s immigration-related arrest. A Coast Guard Investigative Service investigation first confirmed his illegal presence in the United States.

With that confirmation, ICE’s Office of Enforcement and Removal Operations proceeded to arrest him formally. Hernández, a Salvadoran national, told authorities that he entered the United States through Texas in 2007. According to DHS, at that time he falsely claimed to be a U.S. citizen.

The captain remains in ICE custody while awaiting his criminal trial. Once that case concludes and any sentence is served, he will face formal deportation proceedings, according to the federal agency.

Criminal Charges and Bail Conditions

Hernández faces two federal charges of misconduct and negligence as a vessel officer. Both charges are directly related to the deaths of the mother and her daughter. During his first court appearance on August 10, he pleaded neither guilty nor innocent before federal court.

That same day, the captain was released on personal bond of $50,000. The imposed conditions include an absolute prohibition from operating any type of boat or vessel while the case proceeds.

In addition to federal charges, Hernández faces 13 state charges of reckless endangerment. That accusation comes directly from the New York Police Department, which investigated the case in parallel with federal authorities.

Investigation into the Capsizing

Authorities are investigating whether Hernández was operating an illegal rental service, without required credentials or safety equipment. Federal regulations require stricter inspections for commercial vessels carrying more than six passengers.

The trip was part of a birthday celebration, according to a law enforcement officer who spoke with CNN. The capsizing triggered an immediate emergency response in the harbor, between the Statue of Liberty and the Brooklyn shoreline.

Twelve people were rescued alive from the water. However, two victims were found in critical condition. Sara Sánchez, 27, and her daughter Antonella García, five months old, both Queens residents, were taken to the hospital, where they died shortly after.

The baby’s father, Andrés García, survived the boating accident. The couple’s six-year-old son was being cared for by a babysitter during the trip, according to one of García’s coworkers.

According to the complaint, prosecutors contend that Hernández steered the vessel directly toward a wave. He accelerated to try to cross it, until water flooded the bow and caused the boat to capsize immediately. Prosecutors added a critical detail: there were no life jackets for babies aboard.

Coast Guard Investigative Service

Josh Packer, deputy director of the Coast Guard Investigative Service, commented on the case. On his official account, he described illegal charter operations as a direct risk to human life. He stated that in this case, the reported conduct resulted in an unimaginable tragedy.

Packer added that the agency will continue investigating alongside federal, state, and local partners. Its goal, he explained, is to identify those who ignore passenger vessel safety laws.

The Coast Guard confirmed it continues investigating the exact causes of the capsizing. It is working in coordination with the Coast Guard Investigative Service and the New York Police Department to reconstruct the final minutes before the tragedy.
