Maduro Appears in New York Over Legal Immunity

Deposed Venezuelan President Nicolás Maduro and his wife, Cilia Flores, appeared Wednesday before a federal court in New York. The judge presiding over the case proposed that the trial begin on June 1, 2027. This will come after the defense presents an immunity motion in an attempt to stop the judicial proceedings.

The brief status hearing, which lasted only 18 minutes, focused on the legal calendar for the case. The case accuses the former president of leading a narco-terrorism structure and conspiring to flood the United States with cocaine.

How Did Maduro and Flores Appear?

Maduro, 63, arrived at federal court walking normally, showing a better appearance and without the slight limp that affected him in previous hearings. He maintained his characteristic mustache, though he appeared thinner and with grayer hair. During the session he repeatedly touched his headphones and conversed with his legal team, headed by attorney Barry Pollack.

Cilia Flores, 69, also presented a healthier appearance than in the past. She entered the courtroom behind her husband. She wore glasses, her hair pulled back in a ponytail, and the same khaki prison uniform as Maduro.

Both remain in custody at a federal prison in Brooklyn since January 2026. They were transferred to New York after being captured in Caracas by U.S. forces in a military operation authorized by the Donald Trump administration. Since their first appearance, the couple has pleaded “not guilty” to all charges. Additionally, Maduro asserted to the judge that he was a “decent man” and the “constitutional president” of his country.

What Legal Strategy Will They Use to Avoid Trial?

Before the hearing, prosecutors and the defense agreed on a work schedule that was accepted by Judge Alvin Hellerstein, 91. The plan includes two rounds of pre-trial motions, scheduled before the trial begins in June 2027.

The defense’s main strategy will be an immunity motion. Attorney Barry Pollack indicated they will present this argument before the deadline for evidence disclosure expires. The defense contends that Maduro enjoyed immunity as head of state of Venezuela at the time of his capture. If the judge approves the motion, the trial could be dismissed. Maduro would not have to participate in the second round of hearings.
