A federal judge from the Southern District of New York struck down the State Department policy that suspended the processing of immigrant visas for citizens of 75 countries. Judge Jeannette Vargas determined in her ruling that Secretary of State Marco Rubio exceeded his legal authority by imposing a blanket restriction. The judicial resolution concluded that the measure was manifestly illegal as it violated the obligation to evaluate each case individually.

The federal administration had justified the suspension by arguing that applicants from those nations represented an elevated risk of becoming a public burden to the country. However, the court clarified that current immigration law requires analyzing the finances, education, and personal resources of each applicant. The decision benefits thousands of families who had permanent residency or immigrant visa proceedings halted since the start of the year.

Impact of the Ruling on Immigrant Communities

The suspension affected citizens from diverse nations in Latin America, such as Brazil, Colombia, Guatemala, Haiti, Nicaragua, and Uruguay. The list also included countries from Asia, Africa, and the Middle East whose citizens sought to reunify with family members in U.S. territory. With the annulment of the measure, embassies and consulates must resume processing of applications that remained blocked.

Civil organizations such as the National Immigration Law Center, a defender of immigrant community rights, celebrated the judicial resolution. The entities noted that the decision protects due process for those who meet legal requirements to enter regularly. The ruling also establishes a review of applications that were denied solely on the basis of nationality.

The Immigration and Nationality Act (INA) establishes that consular officers must apply specific criteria before rejecting an application on grounds of public charge. The U.S. Citizenship and Immigration Services (USCIS) requires analyzing age, health status, family situation, and work skills of each person. Judge Vargas’s decision reaffirms that the Executive Branch cannot ignore these parliamentary guidelines to apply mass vetoes.

The State Department maintains that it upholds the most rigorous verification standards to protect national security and the economy. However, the judicial ruling compels the agency to resume evaluations based on individual evidence in each case file. Affected families can consult with an immigration attorney or review the status of their applications through the official government portal.
